Refund & Cancellation Policy for Programs:

(Effective for all programs under HROHOUR)

This Refund & Cancellation Policy (“Policy”) serves as a formal Memorandum of Understanding (MoU) between HROHOUR (“the Organization”) and any enrolled participant (“the Participant”). By enrolling in any program, workshop, diploma, or course offered by HROHOUR, the Participant acknowledges, accepts, and agrees to abide by the following terms and conditions:



1. Payments Below ₹10,000

• All payments below ₹10,000 are strictly non-refundable.
• The pricing in this range is structured based on scale, affordability, and administrative allocations.
• Once the transaction is completed, no claims for refunds or partial adjustments will be entertained.



2. Payments Above ₹10,000

• Refund requests for amounts exceeding ₹10,000 may only be considered if:
• A written request is submitted via official HROHOUR communication channels (email or portal), within seven (7) calendar days of payment.
• The request clearly states the reason for discontinuation.
• After Seven Days:
• No refund claims will be entertained, regardless of circumstances.
• Fees paid will be considered final, binding, and non-recoverable.



3. Cancellations by HROHOUR

• In the unlikely event that HROHOUR cancels an entire course/program, Participants are entitled to:
• Two (2) free courses of equal or lesser value as compensation.
• If only course dates are rescheduled:
• No refunds will be issued.
• The Participant will instead be entitled to one (1) free course of equal or lesser value in addition to the rescheduled program seat.



4. Participant Cancellations

• If a Participant chooses to withdraw, discontinue, or fails to attend a program due to personal, professional, or health reasons:
• No refund will be provided, regardless of payment amount, course progress, or attendance.
• The responsibility of completing the program rests solely with the Participant.



5. Non-Transferability of Payments

• Payments once made are non-transferable to another individual.
• Any credit provided (as per Clause 3) is applicable only to the original Participant and is not exchangeable for cash or third-party enrollment.



6. Binding Effect

• This Policy is legally binding upon both the Organization and the Participant.
• By making payment, the Participant affirms that they:
• Have read and fully understood the Policy.
• Voluntarily agree to all its terms without exception.
• Recognize that no verbal, informal, or external assurances shall override this written Policy.



7. Governing Clause

This Policy shall be governed under the applicable laws of India, and any disputes arising will be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

Code of Conduct & Anti-Harassment Policy

(Binding under Indian Law – Applicable to all Participants and Public Interactions with HROHOUR)

At HROHOUR, we are committed to upholding the highest standards of professionalism, education, and respect. To protect our team, our students, and the integrity of our programs, we have established the following Code of Conduct & Anti-Harassment Policy.

By enrolling in any program, engaging with our staff, or interacting with HROHOUR in any capacity, participants and the public agree to abide by the following rules, which are binding in law under the Indian Contract Act, Indian Penal Code (IPC), the Information Technology Act, and applicable Defamation laws.



1. Standard of Conduct

• Participants and stakeholders are expected to treat HROHOUR staff, trainers, and community members with courtesy, professionalism, and respect at all times.
• Misbehavior — including use of abusive language, harassment through repeated calls/messages, or intimidation — will not be tolerated.

Legal Basis: Such conduct falls under Section 503 & 506 IPC (criminal intimidation) and Section 509 IPC (insulting behavior).



2. Harassment & Abuse

Harassment includes, but is not limited to:
• Aggressive or threatening emails, calls, or messages.
• Repeated baseless refund requests after a case has been closed.
• Attempts to coerce, intimidate, or pressure staff outside of established policies.

Enforcement:
• Participants engaging in harassment will face immediate termination of enrollment without refund.
• HROHOUR reserves the right to levy administrative/legal service charges (minimum ₹5,000, recoverable in law).
• Serious cases will result in civil and criminal proceedings.



3. Defamation & False Public Claims

We maintain high educational standards and a transparent curriculum. Any attempt to maliciously harm the reputation of HROHOUR will be treated as defamation. This includes:
• Posting false or misleading claims about course quality or standards.
• Making defamatory remarks in public forums, social media, or reviews with the intent to harm HROHOUR’s reputation.
• Spreading misinformation or false allegations to discourage enrollment.

Legal Basis:
• Section 499 & 500 IPC (Defamation) provides criminal penalties for false statements that harm reputation.
• Civil Defamation Law entitles HROHOUR to claim damages, compensation, and injunctions against individuals who spread falsehoods.
• IT Act Section 66A/67 applies for defamatory or harassing content posted electronically.

Enforcement:
• HROHOUR reserves the right to initiate legal proceedings for damages and compensation against individuals making defamatory claims.
• Participants or third parties found engaging in such conduct may be blacklisted permanently from all future HROHOUR programs.



4. Misuse of Grievance Process

• Genuine concerns will always be heard through official communication channels.
• However, misuse of grievance redressal by spamming, trolling, or escalating without merit will be treated as harassment.



5. Termination & Blacklisting

• Any violation of this Policy allows HROHOUR to terminate the enrollment immediately, without refund.
• The violator may be blacklisted permanently from future programs, workshops, or collaborations with HROHOUR.



6. Legal Recourse

HROHOUR retains the right to:
• Initiate civil suits for damages, compensation, and injunctions.
• File criminal complaints under IPC and IT Act for harassment, intimidation, or defamation.
• Seek recovery of administrative/legal costs incurred in handling misconduct.



7. Binding Acceptance

By enrolling in or engaging with HROHOUR, every Participant and stakeholder:
• Accepts this Code of Conduct & Anti-Harassment Policy as legally binding.
• Understands that misbehavior, harassment, defamation, or misuse of policy will invite financial, contractual, and legal consequences.
• Acknowledges that no verbal or informal assurances shall override this Policy.
